TALENT RELEASE, IMAGE RIGHTS & WAIVER
This Agreement is intended for comedians, performers, musicians, speakers, talent, and any other individuals appearing at events produced or presented by Salisbury & Associates, LLC d/b/a Wylde Style Productions (“Producer”).
Salisbury & Associates, LLC d/b/a Wylde Style Productions (“Producer”) produces and promotes live and recorded arts and entertainment events. In connection with these events, Producer may capture photographs, video recordings, audio recordings, livestreams, and other media depicting Talent and/or their performance.
By signing this Release, you (“Talent”) acknowledge and agree to the following:
- Grant of Rights
Talent irrevocably grants Producer and its affiliates, successors, assigns, and licensees the unrestricted, perpetual, worldwide, royalty-free right and license to photograph, record, film, livestream, reproduce, edit, modify, distribute, publicly perform, publicly display, broadcast, transmit, publish, and otherwise use Talent’s name, likeness, image, voice, performance, biographical information, and any materials captured (collectively, the “Materials”) in any media now known or hereafter devised, for any lawful purpose, including but not limited to:
- Marketing, advertising, promotion, publicity
- Social media, websites, apps, streaming platforms
- Broadcast, print, digital, and archival use
- Commercial, editorial, or promotional content
- Internal or external communications
- Ownership
Talent agrees that all Materials shall be the exclusive property of Producer, and that Producer shall be deemed the sole owner of all copyrights and other intellectual property rights in the Materials. Talent waives any right to inspect or approve the finished Materials or their use.
- No Compensation
Talent acknowledges and agrees that no compensation, royalties, residuals, or other payment is due or will be due now or in the future for the use of the Materials, regardless of the manner or extent of such use.
- Waiver & Release
Talent hereby releases, waives, and discharges Producer and its affiliates, owners, officers, employees, contractors, agents, successors, and assigns from any and all claims, demands, liabilities, damages, or causes of action of any kind, whether known or unknown, arising out of or related to:
- The capture or use of the Materials
- Any alteration, distortion, or contextual use of the Materials
- Claims for invasion of privacy, right of publicity, defamation, or misappropriation
- Representations
Talent represents and warrants that:
- They are at least 18 years of age, or have the consent of a parent or legal guardian
- They have the full right and authority to enter into this Agreement
- Their participation does not violate any existing agreements or obligations
- Binding Effect
This Agreement shall be binding upon Talent and their heirs, legal representatives, and assigns, and shall inure to the benefit of Producer and its successors and assigns.
- Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.
